Why product announcements?

The quality of the product or food greatly affects the health of consumers, so all domestically produced or imported products or foods must conduct self-declaration of products according to the law.

According to the Government's Decree 15/2018/NĐ-CP, which clearly stipulates the implementation of a number of articles of the Law on Food Safety: It stipulates that all organizations and individuals that are producing and trading food in Vietnam must comply with the provisions of this Decree. self-declaration of products  (or declaration of conformity) for their products with competent state agencies before being displayed for sale and circulated on the market.

Product self-declaration applies to: Processed, Prepackaged foods; Additives; Processing aids; Tools, Packaging Materials, Food containers (collectively referred to as products) have technical regulations QCVN or TCVN.

What do businesses self-declare products need?

Product self-declaration documents include:

• Self-declaration of products according to (Form No. 01, Appendix I issued together with Decree 15; here)
• The certificate of food safety test results of the product within 12 months from the date of application is issued by a designated testing laboratory or a laboratory accredited in accordance with ISO 17025.

The self-declaration of products is carried out in the following order:

• Enterprises and individuals self-publish their products on the mass media or their electronic information pages or publicly list them at the offices of enterprises or individuals and submit 01 copy by post or in person. to the competent state management agency designated by the People's Committee of the province;
• Immediately after self-declaration, organizations and individuals are entitled to produce and trade products and take full responsibility for the safety of such products;
• Competent state management agencies shall receive self-published copies of organizations and individuals to store dossiers and publish names of organizations and individuals and names of self-published products on their websites. application-receiving agency.

In case an organization or individual has 2 or more production establishments that produce the same product, the organization or individual shall only submit the application at a local state management agency in which the production facility is located. selected organizations and individuals. Once the state management agency has been selected to submit the dossier, the subsequent self-announcement must submit the dossier at the previously selected agency.

Note:

• Documents in the self-declaration dossier must be presented in Vietnamese; in case there is a document in a foreign language, it must be translated into Vietnamese and notarized and must be valid at the time of self-declaration.
• In case there is a change in product name, origin or composition, the organization or individual must re-announce the product. In case of other changes, organizations and individuals shall notify in writing of the changed contents to competent state management agencies and may manufacture and trade products immediately after sending the notices.
