Nutrition Labeling Compliance under Circular 29/2023/TT-BYT – Mandatory from 2026

From 01 January 2026, all organizations and individuals must not manufacture, print, import, or use nutrition labels that do not comply with the requirements stipulated in Circular 29/2023/TT-BYT issued by the Ministry of Health.

 

What Does Circular 29 Regulate?

Scope of Application

Applies to pre-packaged foods manufactured, traded, imported, and circulated in Vietnam.

12 Exempted Product Groups

The following categories are not required to display nutritional composition:

  1. Ingredients and food products not sold directly to consumers, including edible ice.
  2. Foods containing a single ingredient.
  3. Natural mineral water and bottled drinking water (including those only added with CO₂ and/or flavorings).
  4. Table salt and refined salt.
  5. Vinegar and vinegar substitutes, including products only added with flavorings.
  6. Food flavorings, additives, and processing aids.
  7. Food enzymes.
  8. Tea and coffee without added ingredients other than colorings or flavorings.
  9. Dietary supplements (Health Supplements).
  10. Alcoholic beverages.
  11. Foods regulated under Clause 2, Article 1 of Decree 43/2017/NĐ-CP (amended by Decree 111/2021/NĐ-CP), and foods under Clauses 1 & 2, Article 25 of Decree 15/2018/NĐ-CP.
  12. Foods produced by small-scale food businesses as defined in Clause 10, Article 3 of Decree 15/2018/NĐ-CP.

 

Mandatory Nutrition Components on Labels

  • Energy (kcal)
  • Protein (g)
  • Carbohydrate (g)
  • Fat (g)
  • Sodium (mg)
  • Total Sugars and Saturated Fat (required depending on product type)

 

 

Key Compliance Notes

  • Units, labelling format, and % Reference Nutrient Values (RNV) must follow Article 6 of the Circular.
  • Nutrition tolerance ranges must comply with Clause 1, Article 17 of Decree 43/2017/NĐ-CP.
  • Businesses are fully responsible for the accuracy of declared nutritional values; violations may constitute counterfeit goods under Decree 98/2020/NĐ-CP.

 

Major Labeling Non‑Conformities

 

  • Incorrect measurement units.
  • No determination of average values based on repeated laboratory testing.
  • Production variability causing deviation >30% from declared values.
  • Missing Total Sugars and Saturated Fat.
  • Incorrect nutrition table format.

 

Nutrition Labeling Implementation Checklist

 

  • Classify products & determine applicable nutrition parameters.
  • Establish standard formulation & test samples in an ISO/IEC 17025 accredited laboratory.
  • Calculate energy based on TCVN / EU / FDA principles.
  • Present the nutrition table in the correct standardized format.
  • Conduct legal review & finalize printing.
